A Miami attorney who specializes in income-tax cases said he was not surprised by the judge's ruling, saying that Morgan Stanley, not the tribe, generated the credit-card records.
Attorney David Garvin, who successfully defended Indy 500 champ Helio Castroneves in a criminal tax-evasion trial last year, said he doesn't expect the turnover of the tribe credit-card records to be resolved easily.
``Damage control is in full gear,'' Garvin said. He predicted that the tribe's lawyers would continue to fight the IRS at every turn because the Morgan Stanley records could expose other members besides Cypress to federal scrutiny -- including possible criminal charges.
``Once you start down this slope,'' he said, ``it's like a snowball picking up momentum that's turning into an avalanche.''
